By using E5-Compute services, you confirm that you have read, understood, and agreed to these Terms of Service.
If you do not agree, you must discontinue use of the services immediately.
1. General Terms
1.1 By using E5-Compute services, you agree to comply with these Terms and all related E5-Compute policies.
1.2 These Terms are governed by the laws of the Islamic Republic of Pakistan.
1.3 Any disputes shall fall exclusively under Pakistani courts.
1.4 E5-Compute may update these Terms at any time via email, billing panel, or website notice.
1.5 Continued usage after updates constitutes acceptance of the revised Terms.
2. Definitions
- Services: VPS hosting, cloud hosting, web hosting, and related offerings
- User: Any individual or entity using E5-Compute services
- Account: The registered profile used to access E5-Compute systems
3. Account Responsibilities
Users are fully responsible for maintaining account security and preventing unauthorized access.
3.1 Users must secure credentials, API keys, VPS access, and payment methods.
3.2 Unauthorized access attempts toward other users or infrastructure are strictly prohibited.
3.3 Providing false or misleading information may result in termination.
3.4 E5-Compute reserves the right to suspend or terminate accounts involved in abuse or illegal activities.
4. Age and Legal Capacity
Users must be legally capable of entering binding agreements under Pakistani law.
4.1 Users must meet the legal age requirement.
4.2 Minors may use services only with supervision from a legal guardian.
5. Acceptable Use Policy
[!DANGER] Violations of Pakistani cybercrime laws, including PECA, may result in immediate suspension without notice.
5.1 Illegal activities, hacking attempts, phishing, spamming, or malware distribution are prohibited.
5.2 Users must not interfere with network integrity or service stability.
5.3 Harassment, threats, or defamation toward E5-Compute staff or services is prohibited.
5.4 Content violating Pakistani regulations is strictly forbidden.
6. Resource Usage Policy
Fair usage policies exist to maintain stable infrastructure for all customers.
6.1 Storage usage should not exceed 75% of assigned capacity unless permitted.
6.2 CPU and RAM usage is unrestricted unless it negatively impacts other users.
6.3 E5-Compute may throttle or suspend services causing infrastructure strain.
7. Service Availability and SLA
[!INFO] E5-Compute aims for high availability but does not guarantee uninterrupted service.
7.1 E5-Compute targets reliable uptime.
7.2 A 96.96% uptime SLA applies to VPS services unless otherwise stated.
7.3 Scheduled maintenance and force majeure events are excluded from SLA credits.
7.4 E5-Compute is not responsible for indirect losses resulting from downtime.
8. Payments and Billing
All payments are final unless refunds are required by Pakistani consumer protection laws.
8.1 Failure to pay may result in suspension or termination.
8.2 Users remain responsible for renewals, add-ons, and subscriptions linked to their accounts.
9. Taxes and Compliance
9.1 Users must comply with applicable taxation laws within Pakistan.
9.2 E5-Compute may apply required taxes or duties where legally necessary.
10. Data Responsibility
Users are solely responsible for maintaining backups of their data.
10.1 E5-Compute does not guarantee backups unless explicitly included in a plan.
10.2 Data loss risks are inherent in VPS hosting environments.
11. Privacy and Security
11.1 E5-Compute implements industry-standard security practices.
11.2 Users must immediately report vulnerabilities or unauthorized access.
11.3 Responsible disclosure may qualify for service credit rewards up to $55 depending on severity.
11.4 E5-Compute will comply with lawful requests under Pakistani regulations.
12. Content Restrictions
[!DANGER] Hosting extremist, illegal streaming, or pirated content may lead to immediate suspension.
12.1 All hosted content must comply with Pakistani law.
13. Intellectual Property
13.1 All E5-Compute branding, logos, and software remain E5-Compute property.
13.2 Unauthorized reproduction or redistribution is prohibited without written consent.
14. Service Modifications
14.1 E5-Compute may modify, suspend, or discontinue services without liability.
14.2 Major changes will be communicated where reasonably possible.
15. Support and Communication
15.1 Support is provided only through official E5-Compute channels.
15.2 Abuse toward staff may result in account action.
16. Backup and Data Loss
E5-Compute is not liable for user data loss caused by system failures or user actions.
16.1 Users must maintain independent backups.
17. Network Integrity
17.1 Activities causing DDoS attacks, packet abuse, or network disruption are prohibited.
17.2 E5-Compute may null-route or suspend affected services to maintain stability.
18. Software Licensing
18.1 Users must ensure all installed software is properly licensed.
18.2 Pirated or cracked software hosting is prohibited.
19. Suspension Policy
19.1 E5-Compute may suspend services immediately upon detecting violations or legal risks.
19.2 Suspension may occur without prior notice in urgent cases.
20. Termination
20.1 Accounts violating these Terms may be terminated without notice.
20.2 Upon termination, data may be deleted unless retention is legally required.
20.3 Outstanding fees remain payable after termination.
21. Fair Usage
21.1 Services advertised as unlimited remain subject to fair usage policies.
21.2 Abuse impacting infrastructure may result in restrictions.
22. Abuse Reports
22.1 E5-Compute investigates abuse complaints according to Pakistani cyber laws.
22.2 Users must cooperate with investigations where required.
23. Reselling
23.1 Reselling services is permitted only if compliant with E5-Compute policies.
23.2 Resellers remain responsible for their customers’ actions.
24. Third-Party Services
24.1 E5-Compute is not responsible for downtime caused by external providers or integrations.
25. Security Testing
[!DANGER] Unauthorized penetration testing against E5-Compute infrastructure is strictly prohibited without written approval.
26. Data Retention
26.1 E5-Compute may retain logs or billing records to comply with legal obligations in Pakistan.
27. Force Majeure
27.1 E5-Compute is not liable for delays caused by natural disasters, government actions, or events beyond reasonable control.
28. Limitation of Liability
28.1 E5-Compute shall not be liable for indirect, incidental, or consequential damages.
28.2 Users acknowledge inherent risks in VPS hosting environments.
29. Indemnification
29.1 Users agree to indemnify E5-Compute against claims resulting from misuse of services or legal violations.
30. Advertising and Branding
30.1 Users may not misrepresent affiliation with E5-Compute without permission.
31. Domain and DNS Usage
31.1 Domains configured on E5-Compute must comply with ICANN policies and Pakistani regulations.
32. Monitoring and Enforcement
32.1 E5-Compute may monitor services to ensure compliance with legal obligations and infrastructure protection.
33. Refund Exceptions
33.1 Refunds may be issued only when required by Pakistani consumer protection law or at E5-Compute’s discretion.
34. Language and Interpretation
34.1 In case of translation conflicts, the English version of these Terms shall prevail.
35. Entire Agreement
35.1 These Terms represent the complete agreement between E5-Compute and the user regarding service usage.
